These Terms of Service (“Terms”) govern your use of the Anymail mobile apps, websites, services, and software (collectively, “Anymail”) provided by Koltir LLC (“Company,” “we,” or “our”). Please read these Terms carefully before using Anymail. They apply to all visitors, users, and others who access Anymail (“users”).

By using Anymail, you agree to be bound by these Terms and consent to the collection and use of your information as outlined in our Privacy Policy. If you are using Anymail on behalf of an organization, you agree to these Terms on behalf of that organization and confirm that you have the authority to do so (“you” and “your” refer to that organization).

Using Anymail

Anymail is an application and cloud service that helps you manage your email accounts and calendar. You can add various mail accounts, including Gmail, Yahoo, AOL, iCloud, Outlook.com, Office365, and Exchange.

When signing up for Anymail, you agree to provide accurate information. You are responsible for all activities under your Anymail account and for safeguarding any passwords you use. Unauthorized access to another user’s account is prohibited.

We trust you to use Anymail responsibly. You agree not to:

  • Copy, distribute, or disclose any part of Anymail in any medium.
  • Probe, scan, or test the vulnerability of any system or network.
  • Breach or circumvent any security or authentication measures.
  • Interfere with or disrupt any user, host, or network (e.g., sending viruses, overloading, spamming, or mail-bombing any part of Anymail).
  • Plant malware or use Anymail to distribute malware.
  • Send unsolicited communications, promotions, advertisements, or spam.
  • Send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing.”
  • Publish anything fraudulent, misleading, or infringing on another’s rights.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Violate the law or the privacy of others, or defame others (e.g., sending illegal or defamatory emails with Anymail).

We may suspend or terminate your access to Anymail without notice and liability for any reason, including your violation of these Terms. Upon termination, you remain bound by these Terms.

Legal Capacity, Children, and Minors

If you are under the age of consent to form a binding agreement in your country, you should use Anymail only if you are an emancipated minor or have the legal consent of your parent or guardian. You should use Anymail only if you are fully able to understand and comply with these Terms. Use of Anymail by anyone under 13 is strictly prohibited.

Usage

Anymail allows you to connect your email account so we can check, process, and deliver email on your behalf. By using Anymail, you permit us to manage content, information, emails, and attachments in those emails. You also grant us permission to host or share your data as directed through Anymail. This includes receiving and sending emails and creating backups to ensure data safety and accessibility. Our Privacy Policy details how we collect and use your information.

Our Proprietary Rights

We retain all rights, title, and interest in Anymail, including all software, design, text, graphics, logos, patents, trademarks, service marks, copyrights (“our stuff”), and all related intellectual property rights. Subject to these Terms, we grant you a non-exclusive, limited, non-transferable, freely revocable license to use Anymail for personal, non-commercial use only. Unauthorized use of our trademarks, logos, domain names, or other brand features is strictly prohibited.

If you provide us with feedback or ideas about Anymail (“ideas”), you agree that we may use and share these ideas without any obligation to you.

User Data

You are responsible for your data and for what you copy, share, upload, download, attach, send, receive, record, or otherwise use while using Anymail. You must have the necessary rights to use your data on or through Anymail.

We respond to notices of alleged copyright infringement as set out in the U.S. Digital Millennium Copyright Act. Notices should be reported as outlined in our DMCA Policy. We may suspend accounts or remove content that infringes copyright.

Privacy and Security

Your privacy is important to us. Our Privacy Policy explains how we collect, use, process, transfer, protect, retain, and maintain personal information and is incorporated into these Terms.

Software from App Stores

These Terms apply solely between you and Company, not Apple, Google (collectively, “App Stores”). The App Stores are not responsible for Anymail or its content. Your use of Anymail must comply with the respective App Store’s Terms of Service.

Maintenance and Support: The App Stores have no obligation to provide maintenance or support services for Anymail. If Anymail fails to conform to any applicable warranty, you may notify the relevant App Store, and they will refund the purchase price of Anymail to you. Beyond this, the App Stores have no other warranty obligations.

Responsibility: The App Stores are not responsible for addressing any claims related to Anymail or your use of it, including but not limited to:

  • Product liability claims.
  • Claims that Anymail fails to conform to any legal or regulatory requirements.
  • Claims arising under consumer protection or similar legislation.

Intellectual Property: In the event of any third-party claim that Anymail infringes on intellectual property rights, Company, not the App Stores, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Third-Party Beneficiaries: You and Company acknowledge and agree that the App Stores and their subsidiaries are third-party beneficiaries of these Terms as they relate to your license of Anymail. Upon your acceptance of these Terms, the App Stores will have the right to enforce these Terms against you as third-party beneficiaries.

You further agree to abide by any third-party terms that apply when posting reviews of Anymail, including the Apple App Store Terms of Service, Google Play Terms of Service.

Updates

We may issue upgraded versions of the Application. These Terms apply to all upgrades. Third-party code incorporated in the Application is covered by the applicable open source or third-party license.

Premium Features

While the standard Anymail services are free, additional data charges may apply through your mobile service provider. Fees may also apply for premium features (“Premium Features”). Payments for Premium Features may be processed by third parties or directly by app stores. Subscriptions automatically renew unless you turn off auto-renewal as specified in your account settings.

Modifying and Terminating Service

We may add or remove features and may stop, suspend, or change Anymail at any time without notice. We may also remove content at our discretion.

Miscellaneous Legal Terms

Indemnity: You agree to defend, indemnify, and hold harmless Company and its subsidiaries, agents, licensors, from any claims, damages, losses, liabilities, costs, or expenses arising from your use of Anymail, violation of these Terms, violation of any third-party rights, or violation of any applicable law.

No Warranty: Anymail is provided “as-is” and “as available.” We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: To the maximum extent permitted by law, Company is not liable for any indirect, special, incidental, punitive, exemplary, or consequential damages. Our liability is limited to the greater of $20 or the amounts paid by you to Company for the past three months.

Notification Procedures and Changes to These Terms: We may provide notifications via email, written notice, or posting on our website. We may modify or update these Terms, and your continued use of Anymail constitutes acceptance of the new Terms.

Governing Law: These Terms are governed by the laws of New York, NY, USA. Disputes are resolved through binding arbitration by the American Arbitration Association.

These Terms constitute the entire agreement between you and Company regarding Anymail. If a provision is unenforceable, the remaining provisions will remain in effect. You may not assign your rights under these Terms, but Company may assign them without restriction. The relationship between you and Company is that of independent contractors.
